The Service includes: - Recording and analysis of training sessions via camera - AI-powered motion detection and throw evaluation - Storage of session data and throw statistics - Comparison of training sessions - Personalized improvement suggestions - Dashboard with statistics and progress tracking - Community features and friend lists (optional) § 3 Registration and User Account --------------------------------- 1. Registration with a valid name and email address is required to use the Service. 2. You are responsible for keeping your login credentials confidential. 3. In case of misuse or unauthorized access to your account, please inform us immediately. 4. We reserve the right to suspend or delete user accounts in case of violation of these Terms. § 4 Terms of Use ---------------- 1. The use of the Service is intended exclusively for personal, non-commercial use. 2. You agree not to misuse the Service or excessively burden the technical infrastructure. 3. Automated data extraction or scraping is not permitted. 4. Sharing login credentials with third parties (account sharing) is not permitted. Each user account may only be used by a single person. 5. Different terms apply to clubs and organizations that have subscribed to a corresponding club or team plan. In this case, shared use is permitted within the respective plan conditions. § 5 Camera Usage ---------------- Camera images are processed exclusively locally on your device. No video or image data is transmitted to our servers. Only calculated metrics (numerical values) are stored server-side. § 6 Availability ---------------- We strive for uninterrupted availability of the Service. There is no entitlement to constant availability. Maintenance work, technical failures, or force majeure may lead to temporary restrictions. § 7 Liability and Accuracy of Measurements ------------------------------------------ 1. The analysis results serve exclusively as training support and do not constitute professional sports advice. 2. All displayed measurements (angles, scores, speeds, and other metrics) are to be understood as guidelines and approximations. These are not exact scientific or metrologically calibrated values. The accuracy of measurements can be influenced by various factors, including camera position, lighting, image quality, and body posture. 3. We are not liable for the correctness, accuracy, or completeness of the provided analysis data, measurements, and improvement suggestions. 4. Liability for damages arising from the use or non-use of the provided information is excluded, except in cases of intentional or grossly negligent fault. § 8 Termination and Account Deletion ------------------------------------ 1. You can delete your user account at any time without giving reasons via the profile page. 2. Upon deletion of the account, all stored data will be permanently removed. 3. We reserve the right to delete inactive accounts after reasonable notice. § 9 Changes to Terms -------------------- We reserve the right to change these Terms at any time. Registered users will be informed of significant changes by email. Continued use of the Service after a change constitutes acceptance of the new Terms. § 10 Beta Phase and Final Survey -------------------------------- The Service may be provided as a beta version from time to time. By participating in the beta phase, you agree that we may contact you once by email after the beta phase ends to invite you to a final survey regarding the use and further development of mydart. § 11 Final Provisions --------------------- 1. German law applies. 2. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected. 3. The place of jurisdiction is, where legally permissible, the location of the provider.
