Last updated: 04/05/2026 § 1 Organizer ------------- The organizer of the giveaway is mydart - Malte Heyenga, Am Lövenicher Weg 1, 41812 Erkelenz, Germany (hereinafter "Organizer"). Contact can be made via email: kontakt@mydart.app. § 2 Scope --------- These terms and conditions govern participation in the voucher giveaway in connection with the beta phase of the mydart web application. By participating in the giveaway, participants accept these conditions. § 3 Eligibility --------------- Eligible to participate are only natural persons aged 18 or older with a permanent residence in Germany who have created a valid user account with mydart during the beta phase. Participation of employees of the organizer and their relatives is excluded. Legal recourse is excluded. § 4 Prize Requirements ---------------------- To be considered for a voucher prize, the following requirements must be met: 1. Participation in the mydart beta phase with a registered user account 2. At least one training session with at least 10 thrown and analyzed throws completed 3. The final survey fully completed All three requirements must be fulfilled by the end of the beta phase. The organizer will verify the fulfillment of the requirements based on stored usage data. § 5 Period ---------- The giveaway is tied to the duration of the mydart beta phase. The specific period and the end of the beta phase will be determined by the organizer and announced on the website or via email. § 6 Prize and Winner Determination ---------------------------------- - Winners will be determined after the end of the beta phase by random selection from all participants who have met the requirements set out in § 4. - Winners will be notified by email to the address provided during registration. - The prize must be claimed within 14 days of notification. If no response is received within this period, the claim to the prize will lapse and a replacement winner will be drawn. - There is no legal claim to the prize. The prize cannot be paid out in cash or exchanged. § 7 Grounds for Exclusion ------------------------- The organizer reserves the right to exclude participants from the giveaway who violate these terms and conditions, use unauthorized aids, take manipulative measures, or attempt to influence the chance of winning through technical intervention. § 8 Data Processing ------------------- For the conduct of the giveaway, the data required for participation and winner determination (in particular email address, usage data for verifying the requirements) will be processed. Processing is carried out in accordance with the mydart privacy policy. § 9 Liability ------------- The organizer is not liable for technical failures that are outside its area of responsibility. Similarly, the organizer assumes no liability for lost or undelivered prize notifications. § 10 Early Termination ---------------------- The organizer reserves the right to terminate the giveaway early for important reasons (e.g. technical failures, manipulation attempts) or to change the terms and conditions of participation. § 11 Final Provisions --------------------- 1. The law of the Federal Republic of Germany applies. 2. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. 3. The place of jurisdiction is, where legally permissible, the seat of the organizer.
